These Terms of Service ("Terms") apply when you place an order or otherwise use the website operated under the brand Nearplugs ("we", "us", "our"), owned and operated by Feutch AB, company registration number 559268-6470.

By completing a purchase on our website, you confirm that you have read, understood and agree to be bound by these Terms.

2. Scope of the Agreement

These Terms govern the sale of products via our website to consumers. By placing an order, a binding agreement is formed once we have confirmed your order.

We reserve the right to update or amend these Terms at any time. The version available on the website at the time of purchase shall apply to your order.

3. Products and Availability

We sell accessories designed for use with earphones, including ear cushions and similar products.

Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition.

All product descriptions, images and information are provided for informational purposes only. We reserve the right to change or discontinue products at any time without prior notice.

Due to differences in screen settings and the use of 3D-rendered images, the actual product appearance may differ slightly from what is shown on the website.

All content on the website, including but not limited to text, images, trademarks, logos, product names and design, is the property of Nearplugs or its licensors and may not be copied, reproduced, distributed or used for commercial purposes without our prior written consent.

4. Prices and Payment

All prices are displayed in the currency applicable to your selected country or region and include applicable VAT where required by law.

The final price, including shipping costs and any applicable taxes, is clearly shown at checkout before you complete your purchase.

Payment is handled through Shopify Payments and its integrated payment methods, which may include card payments, Klarna, Apple Pay, Google Pay and PayPal. By completing a purchase, you agree to the terms and conditions of the selected payment provider.

We reserve the right to correct typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions and availability at any time, and to cancel or refuse orders placed based on incorrect information.

5. Order Process

An order is placed by completing the checkout process on our website. Once your order has been placed, you will receive an order confirmation via email. This confirmation constitutes our acceptance of your order.

We reserve the right to refuse or cancel an order for any reason, including but not limited to suspected fraud, incorrect pricing, or stock availability issues.

6. Shipping and Delivery

We ship to the countries and regions made available during checkout.

Shipping costs and available delivery methods are clearly displayed at checkout before completing your purchase.

Estimated delivery times:

Sweden: 1–5 business days
Europe: 1–9 business days
Other countries: Shown at checkout

Delivery times may vary depending on the selected shipping method and destination. The estimated delivery time for each available shipping option is shown at checkout.

Orders placed before 11:00 AM are typically shipped the same day and always within 24 hours on business days. Estimated delivery times are calculated from the time the order has been dispatched. Processing and handling time (typically up to 24 hours on business days) is not included in the stated delivery time.

Orders are processed and dispatched on business days only. Please note that our warehouse does not operate during Swedish public holidays, which may affect processing times.

You are responsible for providing accurate and complete delivery information. If incorrect or incomplete details are provided, we reserve the right to charge any additional costs incurred for re-shipment.

Delivery Address Requirements
The delivery address provided must be a valid and complete address where the recipient can receive deliveries during normal delivery hours. It is the customer's responsibility to ensure that the address and selected shipping method are compatible.

Please note that certain carriers do not deliver to parcel lockers, service points, or pick-up locations unless explicitly selected at checkout. If an incompatible or incorrect address is provided, we reserve the right to cancel the order or charge additional shipping fees for re-delivery.

Customs & import fees
Customers within the European Union will not be charged any customs duties or import fees, as VAT is included in the price at checkout.
Customers in the United Kingdom will not be charged additional fees on orders below £135.
Customers in Norway will not be charged additional fees on orders below 3,000 NOK (VOEC).
For other countries, customs duties and import fees may apply and are the responsibility of the customer.

If you are incorrectly charged customs duties or import fees despite the above conditions, you must contact the shipping carrier or local customs authority directly (e.g., UPS, DHL or local customs office) to resolve the issue.

We are not responsible for customs charges applied by local authorities and cannot refund such fees once imposed.

Unclaimed Packages
If a package is not collected and is returned to us, we reserve the right to charge a handling fee of 150 SEK / 15 EUR. This fee will be deducted from your refund.

7. Right of Withdrawal (Right to Cancel)

As a consumer, you have the right to withdraw from your purchase within 14 days from the day you receive your order.

This right does not apply to products where the packaging has been opened due to hygiene reasons (e.g., ear cushions).

8. Returns and Refunds

Returns are only accepted after prior approval via email.

Products must be unused and in original packaging
The customer is responsible for return shipping costs

Refunds are processed using the original payment method once the returned items have been received and inspected.

9. Defective or Incorrect Products

If you receive a defective or incorrect product, please contact us as soon as possible at info@nearplugs.com.

In cases of verified defects or incorrect deliveries, we will provide a replacement or refund in accordance with applicable consumer protection laws.

10. Product Information & Usage

Our products are designed for use with compatible earphones.

We are not responsible for improper use, compatibility issues, or damage caused to other devices.

11. Limitation of Liability

To the extent permitted by law, Feutch AB shall not be liable for indirect or consequential damages, including loss of profit, data or business interruption.

Our total liability shall in any case be limited to the amount paid for the product.

Nothing in these Terms limits your statutory rights.

12. Force Majeure

We shall not be liable for delays or failures resulting from circumstances beyond our control, including but not limited to natural disasters, supply chain disruptions, governmental actions, strikes or pandemics.

13. Personal Data

We process personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

Personal data is collected to process orders, provide customer support and, where applicable, send marketing communications.

We do not sell personal data to third parties.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Swedish law.
